Thank you for your interest in Acronis International GmbH and its affiliates (each, “Acronis” or “we”). Acronis is committed to handling your personal information responsibly. This Recruitment Data Protection Notice (“Recruitment Notice”) explains the types of personal information Acronis collects from or about you and how Acronis uses this personal information if you choose to apply for employment at Acronis.
In this Recruitment Notice:
Acronis is made up of different entities around the world. The Acronis entity that is responsible for your personal information – sometimes known as the “controller” – generally is the Acronis entity offering the position for which you are applying. Our recruitment team develops and records inferences based on the personal information you provide (such as work history and experience) about your abilities and experience in the context of considering your candidacy for specific roles.
Privacy and data protection laws require that Acronis apply heightened protection to sensitive personal information. Sensitive personal information means information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, genetic data and biometric data for the purpose of uniquely identifying you, information concerning health, information concerning a natural person’s sex life or sexual orientation, government issued IDs, health related information for complying with applicable law and similar personal information that is given special protection under some applicable law, such as age, date of birth, gender identity, transgender status, parental status, military status and precise geolocation.
When you apply for a position, Acronis processes sensitive personal information as necessary to comply with applicable local law, such as government reporting requirements and anti-discrimination laws, and to monitor and promote diversity in our recruiting efforts.
We also process the sensitive personal information that you choose to give us. If the processing of sensitive personal information is not required by law, we will rely on one of the exceptional circumstances under which Acronis legally permitted to process sensitive personal information or seek your explicit consent and explain the purposes for processing (when legally permitted).
Acronis operates closed-circuit television and similar video monitoring (“CCTV”) in certain office spaces. Acronis uses CCTV for security purposes at entries and exits, elevators, stairwells and other common areas. Acronis does not use CCTV monitoring in individual office interiors and areas that are otherwise considered private (e.g., restrooms).
If you visit our facilities for an interview, the CCTV may record you. The CCTV captures video but not audio recordings. The video recordings are retained for up to three months (or a shorter period depending on local law), after which the recordings are automatically deleted and replaced with new recordings on an ongoing basis unless the recordings are needed in the context of a court investigation or to defend legal actions.
Acronis does not currently use automated decision-making technology or profiling technology tools (collectively, “automated processing”) with candidates’ personal information.
Where permitted by law, Acronis may in the future use automated processing technology, including machine learning and artificial intelligence applications. Acronis will provide notice, obtain consent and/or provide meaningful information (when available) about the logic involved in automated processing, where required, to help ensure that consent to automated processing is specific, informed and voluntary and to ensure that candidates are not adversely affected by a decision to withhold or revoke consent to automated processing.
Acronis shares your personal information to carry out the processing purposes described above. This includes:
• Your personal information is accessible to Acronis personnel who require access for the purposes listed in this Recruitment Notice. Acronis employees with access to personal information have committed themselves to confidentiality and are trained to understand the sensitive nature of personal information processing. The legal basis for this processing is Acronis' legitimate business interest in managing the recruitment process to attract the best talent.
• Acronis shares personal information to its affiliates in the EU (specifically, Bulgaria, Germany, Italy and Romania), Serbia, Japan, Singapore and the U.S. and otherwise in the location associated with the opportunity for which you applied. This helps to ensure compliance with and improve Acronis’ global recruitment policies and processes. These disclosures are subject to our intercompany data sharing agreements (including Standard Contractual Clauses, as applicable) that are designed to protect personal information in accordance with this Recruitment Notice and applicable law. The legal basis for this processing is Acronis' legitimate business interest in improving the recruitment process to attract and retain the best talent. Other bases for processing may apply, such as for an evaluative purpose in Singapore.
• Acronis may share limited personal information with employee representatives to comply with rights and obligations as set out by local employment laws. We disclose your personal information to other third parties with your consent, which we will request prior to the disclosure.
• Acronis discloses personal information to third-party technology providers and other suppliers that assist Acronis for recruitment purposes, such as our online recruitment portal and background screening providers (where permitted). Some of these technology providers may use data derived from your personal information to improve and enhance their services, subject to obligations of privacy and confidentiality. Other third parties with which Acronis shares personal information in connection with the recruitment process are relocation, travel, health and safety, facility management, and security service providers. The legal basis for sharing personal information with these providers is your consent. (Exceptions to consent may apply in certain jurisdictions, such as Singapore where processing is permissible for an evaluative purpose.)
• Acronis discloses personal information to professional advisers, such as attorneys, accountants and insurance professionals. The legal basis for sharing personal information with professional advisers is Acronis' legitimate interest in obtaining professional assistance where necessary or appropriate to achieve its business and strategic objectives.
• Acronis shares your personal information in the context of a sale or restructuring of all or part of Acronis' business. The sharing of personal information in this context is Acronis' legitimate interest in reorganizing its business operations in line with strategic objectives.
• Acronis discloses your personal information to competent law enforcement, government regulators (including tax authorities) and courts when Acronis believes disclosure is necessary (i) to comply with the law, (ii) to exercise, establish or defend legal rights to protect our business activities and/or personnel, or (iii) to protect the vital interests of candidates, service providers or another third party.
When Acronis discloses personal information, we require that recipients handle personal information in compliance with applicable law and, whenever possible, our confidentiality and security requirements. If legal requirements limit the sharing of your personal information, Acronis complies with those legal requirements.
Acronis deploys reasonable and appropriate safeguards designed to protect personal information from loss, unavailability or unauthorized access, disclosure, alteration, destruction or other processing. Acronis also uses technical and organizational measures designed to protect the information systems on which personal information is processed and stored. Acronis contractually requires third parties that receive personal information from Acronis to protect personal information from and against unauthorized and other unlawful processing.
Acronis may transfer personal information for processing and storage outside the jurisdiction in which you reside. These other jurisdictions may have data protection laws that are different from the laws of the jurisdiction of your residence and, in some cases, not as protective.
Acronis undertakes these international transfers:
To Acronis Affiliates: As a multi-national company, Acronis transfers personal information to its affiliates in Bulgaria, Germany, Italy, Romania, Serbia, Japan, Singapore and the U.S. and otherwise in the location associated with the opportunity for which you applied. When personal information is transferred among Acronis affiliates, we use appropriate organizational safeguards to protect personal information in accordance with this Recruitment Notice. These safeguards include agreeing to contractual restrictions that require affiliates to protect personal information in compliance with applicable data protection law. For transfers from the EEA, Switzerland or UK, Acronis’ contractual restrictions include Standard Contractual Clauses (with supplements in accordance Switzerland’s Federal Act on Data Protection and the UK’s Data Protection Act 2018) (collectively, “Standard Contractual Clauses”).
To Suppliers: When Acronis transfers personal information across borders to third-party technology providers and other suppliers that assist Acronis for recruitment purposes, Acronis has incorporated the Standard Contractual Clauses into Acronis’ agreements with those technology providers and suppliers and, where applicable, has confirmed their use of binding corporate rules and/or their commitment to comply with the Data Privacy Framework.

If Acronis does not select you as a candidate for employment, Acronis will retain your personal information as long as Acronis has a legal or business purpose to do so (e.g., for managing legal and regulatory actions) and in accordance with applicable law. You also can choose to consent to Acronis’ retention of your personal information so that Acronis can notify you of other opportunities that Acronis believes will interest you. Depending on where you live and work, you may have certain legal rights with respect to your personal information, such as:
• Right of access to your personal information that Acronis controls;
• Right to correct your incomplete or incorrect personal information;
• Right to erasure of your personal information;
• Right to restrict processing of your personal information;
• Right to object to certain processing of your personal information;
• Right to data portability (i.e., right to receive an electronic copy of your personal information that you have provided to Acronis); and
• Right to withdraw consent at any time with future effect. (Withdrawal of consent does not affect the prior processing in most cases).
These privacy rights are not absolute and may apply only in certain circumstances or subject to exceptions. If you revoke your consent or request that Acronis delete your personal information or restrict Acronis’ processing of your personal information needed for the recruitment process, Acronis may not be able to process your application, consider your candidacy or notify you of future opportunities that match your skills and experience. This Acronis California Recruitment Privacy Notice (“California Recruitment Notice”) describes how Acronis collects and processes California Personal Information (defined below) collected from or about our employment candidates who are residents of California (collectively, “California Candidates” or “you”). This California Recruitment Notice is designed to fulfill our obligations under the California Consumer Privacy Act (“CCPA”) including describing how Acronis processes your California Personal Information. In the event of a conflict between any other Acronis policy, statement or notice and this California Recruitment Notice, this California Recruitment Notice will prevail as to California Candidates, unless stated otherwise.
In this California Recruitment Notice, the following terms have the following meanings:

This California Recruitment Notice covers the twelve (12) months prior to the effective date and will be reviewed at least annually and updated as needed.
This California Recruitment Notice does not apply to personal information that Acronis collects from or about customers or users of Acronis services, Acronis’ business partners, or in other human resource contexts (such as current or former employees). Acronis collects California Personal Information from or about you as follows:

Acronis discloses California Personal Information: to Vendors; to you or other third parties at your direction or through your actions; for the additional purposes explained at the time of collection; as required or permitted by CCPA; to governmental entities or as otherwise required to comply with law or legal process or protect or enforce legal rights or obligations or prevent harm; and as part of an acquisition, merger, asset sale or other transaction in which an assignee assumes control over all or part of Acronis’ business.
Subject to restrictions and obligations under CCPA, our Vendors also may use your California Personal Information for approved purposes and may engage their own contractors to help perform services for us.
Acronis may collect or receive (and may have collected or received during the 12-month period prior to the last updated date above) the categories of California Personal Information listed below. These categories track the categories in CCPA, as required by CCPA.
• Personal identifiers – Acronis collects name, alias, postal address, IP address, email address, government-issued identification numbers, and other identifiers. Certain identifiers may be considered sensitive California Personal Information.
• Personal records – Acronis collects name, signature, address, telephone number and financial information, such as bank account information. Some California Personal Information in this category may overlap with other categories.
• Personal characteristics or traits – in some circumstances, Acronis may collect California Personal Information that receives special protection under U.S. law, such as age, gender and nationality. Some of this information may be considered sensitive California Personal Information.
• Internet usage information – Acronis may collect internet usage information, such as network addresses, IP address, identifiers for computers and mobile devices, activity and audit logs, and other information regarding your interaction with our systems.
• Professional or employment-related information – Acronis collects professional, educational or employment related information in the employment or independent contractor context.
• Non-public education records – Acronis may collect education records maintained by an educational institution or party acting on its behalf.
• Health information – Acronis may collect information concerning your health, such as disability related information.
• Inferences from California Personal Information collected – we may draw inferences from other information we collect about you. For example, we may recommend training that may benefit you based on your performance or other information collected.
• Sensitive California Personal Information – we may collect government issued identifiers, race/ethnicity/sexual orientation voluntarily provided for diversity and inclusion purposes and health related information for complying with applicable law.
Acronis collects the above California Personal Information from you for various human resources purposes, including to administer diversity and inclusion initiatives, to onboard new employees and independent contractors, to contact you, to detect and prevent illegal activities and fraud, and for additional similar purposes.
For purposes of this California Recruitment Notice, Acronis does not knowingly collect or process the following categories of California Personal Information.
• Genetic data used for the purpose of uniquely identifying you.
• Children’s data, which means California Personal Information collected from an individual under age 16.
• Biometric information used for the purpose of uniquely identifying you.
• Precise Geolocation, i.e., data that is derived from a device and that is used or intended to be used to locate you within a geographic area that is equal to or less than the area of a circle with a radius of 1,850 feet.
• Contents of email or other electronic communications using Acronis provided devices/systems where Acronis is not the intended recipient.
As described in the CCPA, information that is deidentified or publicly available is not California Personal Information and is outside the scope of this California Recruitment Notice. We reserve the right to convert (or permit others to convert) California Personal Information to deidentified data. We will not attempt to reidentify data that we maintain as deidentified data.

1. What are the Privacy Rights?
Acronis provides you with the privacy rights described in this Section V.
(a) Right to Access/Know
You are entitled to access California Personal Information we have collected about you up to twice per 12-month period. The right to access includes the right to access categories of California Personal Information as well as specific pieces of California Personal Information.

• The categories of sources from which your California Personal Information was collected.
• Acronis’ Business Purposes or commercial purposes for collecting and (if applicable) Selling or Sharing your California Personal Information.

(2) Specific Pieces of California Personal Information
You may request to confirm if we are processing your California Personal Information and, if we are, to obtain a transportable copy (subject to applicable request limits) of your California Personal Information that we have collected and are maintaining. To comply with access requests, Acronis is not required to re-identify information or to keep California Personal Information longer than we need it or are required to by applicable law.
(b) Right to Delete
You may request that Acronis delete California Personal Information about you which we have collected from you unless Acronis has a basis for retaining it under CCPA.
(c) Right to Correct California Personal Information
You have the right to request that we correct inaccuracies that you find in the California Personal Information about you maintained by us.
(d) Do Not Sell / Share
Acronis does not Sell or Share your California Personal Information (as these terms are defined above). But, some third-party analytics, digital advertising and similar technology providers may associate cookies and other tracking technologies that collect personal information about you on www.acronis.com (including subdomains) (“Tracking Technology”) with California Personal Information that we made available, which may be deemed a Sale and/or Share under CCPA.
Acronis will treat California Personal Information collected using Tracking Technology (e.g., cookie ID, IP address and other online IDs and internet or other electronic activity information) by a third-party business not limited to acting as our service provider or contractor (each as defined in CCPA) as a Sale and/or Share subject to a Do Not Sell/Share opt-out request described below. We will not Sell your California Personal Information or Share your California Personal Information for cross-context behavioral advertising once you make a Do Not Sell/Share opt-out request.
We do not Sell or Share your California Personal Information collected outside of the cookie context described above( “Non-cookie California Personal Information”). Examples of Non-cookie California Personal Information include your name, email address, address and telephone number.
Once you create a “Candidate Home Account,” no Tracking Technology is used for targeted advertising purposes or that otherwise would constitute or a Sale or Share under CCPA.
Opt-out for cookie-related California Personal Information: If you want to opt-out of the Sale/Sharing of cookie-related California Personal Information, you can exercise your opt-out right by using our Privacy Preference Center. This is because we use different technologies to apply preferences for opting out of cookie-related California Personal Information vs. Non-cookie California Personal Information. Our Privacy Preference Center enables you to exercise an opt-out request and enable certain cookie preferences on your browser / device. you must exercise your preferences from each browser you use and on each device that you use. Since your browser opt-out is designated by a cookie, if you clear or block cookies, your preferences are no longer effective and you must enable them again by clicking on the “your Privacy Choices” link in the footer of www.acronis.com (if loaded from California) or using https://www.acronis.com/en-us/legal/#cookies. Please also refer to our Cookie Policy for other ways to exercise preferences regarding cookies.
Acronis honors the Global Privacy Control (“GPC”) and similar technology (sometimes called Universal Opt-Out Mechanisms or Opt-Out Preference Signals), as specified by the CCPA.
Acronis relies on third-party providers for obtaining geo-IP location information, including when enabling or disabling cookies and honoring GPC signals.

We will use good faith efforts to determine and correct the problem. We do not knowingly Sell or Share the California Personal Information of individuals under age 16. (e) Right to Limit Sensitive California Personal Information Processing
We only process Sensitive California Personal Information within the permitted purposes enumerated under the CCPA, which are exempt from requests to limit.
2. How to Exercise Privacy Rights

3. Agent Requests
You may use an authorized agent to make a privacy rights request for you. To protect your privacy, we may require you to directly confirm that you authorized the agent to act on your behalf. Once confirmed, your authorized agent may exercise privacy rights on your behalf.
4. Acronis’ Responses
Acronis will make commercially reasonable efforts to identify California Personal Information that we process to respond to a privacy rights request. In some cases, particularly with voluminous requests, we may suggest that you receive a summary of your California Personal Information and offer you the opportunity to elect whether you want to receive all of it. We reserve the right to direct you to where you may access and copy responsive California Personal Information yourself. We typically do not charge a fee to fully respond to your requests; provided, however, that we may charge a reasonable fee or refuse to act upon a request if your request is excessive, repetitive, unfounded or overly burdensome, as permitted under the CCPA. If we determine that the request warrants a fee or that we may refuse it, we will notify you, explaining why we made that decision. We will provide a fee estimate and the opportunity to accept the fee before we will charge you for responding to your request.
1. Non-Discrimination / Non-Retaliation: Acronis will not discriminate or retaliate against you in a manner prohibited by law for the exercise of your privacy rights.
2.Our Rights and the Rights of Others: Acronis may collect, use and disclose your California Personal Information as required or permitted by CCPA. Acronis is not required to honor requests if doing so would infringe Acronis’ or another party’s rights or conflict with applicable law.
3. Notice of Financial Incentive Programs: Acronis does not currently offer financial incentives to California Candidates that are subject to the CCPA. If we provide financial incentives in the future, we will provide notice and obtain consent as required by applicable law.
4. California Shine the Light Law: As required by law, California Candidates have the right to prevent disclosures of “personal information,” as defined by California’s “Shine the Light” law, to third parties for those third parties’ own direct marketing purposes. Currently, Acronis does not make disclosures that are subject to this law.
